Actually, not so Bat. As the law stood at the time (not as it NOW stands) Bentley was illiterate and of low intelligence, almost borderline retarded. However, he was not suffering from epilepsy at the time of the alleged offence, that he was not a “feeble-minded person” under the Mental Deficiency Acts and that he was sane and fit to plead and stand trial.
English law at the time did not recognise the concept of diminished responsibility due to retarded development, though it existed in Scottish law (it was introduced to England by the Homicide Act 1957).
Criminal insanity – where the accused is unable to distinguish right from wrong – was then the only medical defence to murder. Bentley, while suffering severe debilitation, was not insane.
Chris Craig would not have faced execution if found guilty, as he was below the age of 18 when PC Miles was shot. Bentley on the other hand was not.
The key issue at their trial was that the doctrine of ‘constructive malice’ meant that a charge of manslaughter was not an option, as the “malicious intent” of the armed robbery was transferred to the shooting….. hence they were BOTH charged with murder.
Bentley’s best defence would have been that he was effectively under arrest when PC Miles was killed; however, this was only after an attempt to escape, during which a police officer had been wounded and the Court (and the jury) wouldn’t accept this as a valid defence.
Bentley was quite rightly convicted (as the law stood in the early 1950’s) and therefore quite rightly and lawfully executed.
It’s interesting to note that at his first posthumous appeal in 1966, the finding of guilt for murder was upheld by the Court of Appeal – although the sentence itself was not.
It was only after some seriously heavy political interference by Tony Blair, in his constant quest for popularity, was he fully pardoned in 1998.
well said that man. whilst i think dereks killing was wrong, and he shouldnt have been killed. the laws have since been altered beyond all sense. all the hoodrats have to do now, is to claim they have a.d.h.d or a learning disability and they walk. from some pretty nasty crimes including rape and robbery. the pendulum has swung too far the other way now. but i offer no alternatives because frankly i’d shoot em all. but im just a soft old hillbilly. but tell ya wot. the crime rate in my village is pretty small cos we sort it between us, and the coppers leave us be. even the old stocks were used new years eve, when 4 hoodrats from a neighbouring village tried to vandalise the xmas lights. two of em were hog tied and ty wrapped to the stock rings for the duration of some 2 hours. they wont be back for a long time i reckon. and we havent heard a thing from mummy or daddy.

10 January, 2009 at 3:46 pm #388480callme cynical but…. sureley the fact that he ABANDONED his wife and children were a clue ? the female [slapper] preist is single and her not so chaste lifestyle just makes the abstainers jealous. the church bosses would better serve their parishoners if they sorted the paedos out first, and leave the fekless and the stupid be.
10 January, 2009 at 3:28 pm #388225i was reading a newspaper on the train the other day with pictures of several small dead children and their respective uncles father and a dozen or so other men, all wailing and shaking their fists in grief and anger. the picture was very sad to see. a person who was sat oposite me remarked that. these children, while a sickenning sight were better off this way, as there was a very real danger they would have a suicide vest strapped to them in 5 years time anyway. at first i was horrified at the statement, but after visiting the religionofpeace site, i realised just how right he is. whilst this war is evil and wrong on all fronts, it has to be said that the muslim fanatics are the main instigators as always in their holy jihad to kill kill kill the world. tired and sickened by the lot of it.

Isn’t our great Chancellor, Alistair Darling, simply wonderful? He says that he is going to be open, transparent, and honest about future Tax increases and yet ….. and yet ….
Buried deep in the detailed ‘small print’ of Monday’s pre-Budget report is a nasty little surprise that will affect all female JustChat members who are hoping to retire and receive the full State Pension. (This will also affect around 500,000 female members of the public ).
If you are a woman and you have taken time out from work to care for children, or disabled or elderly relatives – until recently you could NOT claim the full State Pension when you retired (at 60) UNLESS you had paid 39 years worth of NI contributions.
James Purnell, the Work & Pensions Secretary, recently announced a concession so that those women who did NOT have the required 39 years worth of contributions could ”buy” up to 12 years worth, at the rate of £8.10 per week. This would enable them to receive either the full pension on retirement, or at least a significantly increased pension.
Good idea you may think, and eminiently fair eh? Well not so fast ladies!
Buried deep in the report is an announcement of a measure, that will come into effect on 6th April 2009, which will have the effect of RAISING these voluntary contributions from an affordable £8.10 a week to £12.03 a week – an INCREASE of 48.5% or an additional £2452 for the full 12 years.
Crafty little chap isn’t he? Yet another stealth tax from darling Gordon and Alistair. Didn’t make a big announcement of THAT in Parliament on Monday did they, eh? Can’t imagine why.
OK here’s how to save yourselves a load of money (and stuff the wicked Chancellor into the bargain):
1). From April 2010, the number of years needed for a person to receive the FULL State Pension will be reduced FROM 44 years for men and 39 years for women ….. TO only 30 years for both men and women.
2). Work out how many FULL years (i.e. April 6th to April 5th) you have accumulated in NI payments from your paid employment over the years…… as well as any anticipated years that you will pay for, if you are still working. This will tell you the total number of paid for years you have (or will have) accumulated by the time you retire.
3). See how many years of these payments you are short of the required 39 years (or will be short of the required 30 years from 2010 onwards) and ”buy” as many years as you can afford (or need) to fill the gap ….. but buy them BEFORE April 5th 2009.
If you do this, you will only pay at the rate of only £8.10 per week and not £12.03 per week.
Investing in a State Pension in this way can make a substantial difference to the weekly amount you will receive on retirement and is an excellent form of investment – especially in these times of financial uncertainty.
you blaggard.. you took the p as well….
