    I take on board what you have said, ML, but it’s not a case of either or: yes, the police have a public duty to stringently investigate claims, although the usual restrictions of time, resources etc apply, but that doesn’t negate the potential benefits of being able to identify the accused. This is not the same as trail by media where sub judice issues are discussed in the public domain or the accused is overtly deemed guilty by the media and general public.

    Yes, human nature often results in people believing the adage that there is usually no smoke without fire. But that doesn’t mean that naming the accused doesn’t have the general benefits previously mentioned.

    We can’t deny that identifying the accused can facilitate the evidential process. Some people will feel braver about coming forward. Others may simply recall relevant things. I think it is far too important a principle of jurisprudence to discount.

    You’re absolutely right about innocent until proven guilty being a guiding tenet of our judicial system, but despite human nature to think negatively of those that are bought before the courts, being accused is not the same as being guilty, and all the usual tools of redress, such as the laws of defamation, still apply.

    Incidentally, my initial guess about Max Clifford was wrong, it seems he has been arrested with suspicion of sexual offences.

    And I also forgot to say that my initial guess is that I wouldn’t be surprised if he has been arrested for withholding information pertaining to one of his clients, in which case the reports should make this clear. But that’s just my initial guess, I could be completely wrong.

    Max Clifford has been arrested in category 3. So someone has made an allegation of sexual assult involving Clifford.

    I don’t know obviously if he is guilty or not and if he is he deserves to pay for the crime, however the point I wish to make is that I think the law should change regarding the naming of men in these circumstances. If they are guilty then yes release their names etc, but when an allegation is made the police usually have to arrest the suspect for questioning. Could turn out he is not guilty, but mud sticks. People become wary, some say no smoke without fire, when sometimes soemone could just be getting their own back on a person for maybe a relationship break up or money matters or somthing trivial like getting custody of the goldfish.

    Very quick response:

    With the exception of very special cases and cases involving young people where reporting restrictions need to be applied, there are very good reasons why accused people are not afforded anonymity. The most obvious is naming the accused facilitates the evidential process. For example, people who may have been victims of the accused may be inspired to step forward, once they know there is a possibility of justice. Also it is important that we are able to see the judicial system at work for various reasons.

    But you’re right: mud sticks. We can address this to a great degree, I think, by ensuring the media that readily reports when someone has been arrested etc just as zealously reports when they are vindicated.

    You’re right about refraining from replying to things you disagree about for the most part. And I tend to ignore a lot. But sometimes when you put statements under the spotlight people might see the error of their ways. There’s many things said on here that have made me take a good look at how I perceive things.

    YOLO is not ‘some illiterate thing those black Americans’ say. It is more of a neologism associated with the internet age than black people or hip hop / gangster culture, rather like ‘lol’ and ‘rofl’.

    The thing that ‘boggles’ my mind is how you appear to feel free to make badly observed assumptions about cultures without actually thinking about it.

    When it comes to identity, we all play roles and emphasise certain sides of our character. Which begs the question, are we pretending to be something that we are not or perhaps more complexly are we shaped by our environment? It’s the same for many of those who are influenced by American hip hop culture. And kids from all races are increasingly influenced by hip hop culture. Those who aspire to live the ‘gangster/ thug life’ may do so because it’s one the codes of survival for the area in which they live or they may simple pretend to be Jay Z or Tupac because they think it might impress the girls. The reasons are complex and not necessarily because they are being foolish.

    One of the beautiful things about the English language, enabling it to become the lingua franca that it has become, is its ability to be protean and flexible, bending to adapt to the unique needs of different cultures, younger generations etc. Words change their meaning over time. We all know this. If I was to call you gay, Tom, you wouldn’t think I was suggesting that you’re a happy chappy. The word ‘gangster’, like many others, is open to various interpretations. If I’m talking about gangsta rap I’m referring to a specific thing and if I use the gangster term in reference to the films of Humphrey Bogart then I’m surely talking about something else.

    I can’t question your claim to be a one-limbed Japanese Samurai. I don’t know you, so who am I to hazard a guess? Likewise I can also use what you have said thus far to help me define how sad I think you are.
