    It’s been in the news recently, just wondered about peoples views on the subject…

    Do you think the attackers rape conviciton should be reduced / the rape victims conpensation be reduced if the victim was drunk or had been drinking?

    Not suprised in the least, it’s a hidious crime and if the man or woman is drunk it shouldn’t be seen as a lesser crime

    It isn’t.

    Isn’t this to do with the amount of compensation a victim of rape is awarded?
    Either that or I misheard some of the discussion that was on the radio this afternoon.

    True. In order to get “compensation” from the Criminal Injuries Compensation Board you have to be the victim of a crime in the first place.

    Given that the females concerned are all rape victims, the argument isn’t about whether rape is “OK” or “not OK” ….. it IS about how much money (i.e. compensation) they should get from the CICB for their “injuries”.

    It is a common maxim in law that if you in some way contribute, by your own negligence, to an injury that you suffer, then your right to compensation is diminished accordingly.

    This principle has been applied to rape victims and it has been suggested that their right to cash compensation should be reduced if they were drunk – using the principle of contributory negilgence as above.

    I must say that there are, I’m sure, cases where the woman being drunk and incapable put herself in a position where she was at additional risk and which a sober woman would not have done.

    I shall now retire to my concrete bunker and await the nuclear blast.

    I just think rape is such a difficult thing to prove and almost impossible if either or both parties are drunk.
    It must be terrible for a woman to go through something like that but it must also be terrible if you are a man falsely accused of it.
    But if think the compo should be the same ,doesn’t matter if she was drunk. If she’s a victim and someone is prosecuted for it then that’s the end of it.

    I D`no !… I know people who are married,& been raped, but have suffered it for years, because of the kids etc! wont say or do anything about it…. more full them!! I dunno about this…But I do know over the years… somebody has only gotta look at me the wrong way, and their gone!! Maybe cos Iv seen things in me childhood..nothing terrible..but me Mum & Dad having rows, I will never suffer CU*Ts ever!!!! 8) Oh maybe a few on here :D

    I think if you’re young its too easy to get into this kind of situation.

    I always tell people a story from my younger days when I’m asked about rape.

    When I was 17 I was working with a guy who was older than me and he ask me come back to his place, watch the football and have a beer.

    After I had a few cans and the game was about ½ thru he ask me “if he could play with my willy”

    I didn’t know he was gay and he was twice the size of me at the time.

    This was the first and last time I have sober up in 10 sec’s, and ran like hell.

    So when young women tell me that they had no idea how they got in that position in the first place, I can understand how they feel.

    Face facts, rapest’s don’t care if your drunk or not, but it does make there job easer.

    I do feel the biggest mistake our courts make is not revealing any other allegations or previous history of rape before a jury.

    Its time the courts take a harder line with these pervs.

    How did you knew he was twice your size? Was he already playing with his todger?
    Is he still twice your size or have you stopped seeing him?
    Which direction did you run? Towards him and into his arms or to the bathroom to have a quick wash?
