    Full title of regulation:

Section 21 of the Drugs Act 2005 and the Misuse of Drugs (Amendment) (No. 2) Regulations 2005

    Relevant to:
Sellers of magic mushrooms or kits for growing magic mushrooms

Takes effect on 18 July 2005

From 18 July 2005, mushrooms containing psilocin – commonly known as magic mushrooms – will be controlled as Class A drugs.

It is already unlawful to sell prepared magic mushrooms or products containing them. The change in regulation will also make it an offence to import, export, produce, supply, possess or possess with intent to supply fresh magic mushrooms. This means that it will be an offence to produce or sell magic mushrooms whatever form they are in, whether prepared or fresh.

If you have been selling magic mushrooms, you will have to take steps as soon as is reasonably practicable to dispose of them. You should either:

    1. destroy them yourself
    2. deliver them to a person who can lawfully take custody of them, such as a police or customs officer.

It will also be an offence to import and sell kits for growing magic mushrooms at home.

If you need to work with these fungi for research purposes, you will be able to apply for a licence to do so from the Home Office Drugs Branch Licensing Section.

Sorry if this news spoils anybody’s fun. All complaints to the Home Secretary please NOT to me !!!
