    is there anyone out there who knows there stuff as far as employment law goes please…..this is a serious request, im in deep with this one through no fault of my own, i have been already let down by the union so im now in the throws of putting the case together myself……..so if there is anyone out there that is willing to give me some time to ‘bounce’ the problem and has the tiime for the full story i really really would appreciate it

    if not lol no probs just a desperate attempt at getting justice. will post this also in serious posts in case some of the intellectuals never visit gen goss lol

    hi doa my union have been on to it for 4 months now the grievance has been put in and the guy the greivance was against (my boss) has been running the show and basically taking the arrongant stance that he is untouchable……….. anyway last monday the union guys met with my boss cos he was obviously handling it to tell him that he had to go ahead with the process but they came out with the offer that he would write a letter i couldnt ever show to anyone (presumably an apology( and by way of compensation he would give me a rise on the increment scale…….the thing is where i work increments have to be passed by full council and full council have already agreed the increment in april (yes after the grievance was issued) and everyone else has had theres already… so i am entitled to it ….not as compensation as a right…… so the offer is his usual arrogant way of handling stuff……. the union have clearly let me down cos the guy from the union said wen i said wot have i got to lose he said ‘your job’ cos they will take u down the capability route and get rid of you that way………..now far be it from me to be cynical here but the union guy has done a complete turn around……..could it be that he regularly goes to card carrying political meetings with my boss who is a prominent local politician???

    that said i have approached some legal people and they all say i have a clear case for bullying and breach of contract …and for them failing to follow wot i smy basic right to have my greivance heard………but wot the hell do i do ……im only one person and cant take the union on to (madness) cos they have mismanaged it anyway ……..but you know what its not about the compensation its about justice..and this man took me very nearly to breaking point ……and for the first time in my life i want to stand up and be counted…. not bullied etc…… i have a case i know i do its just who is gonna do it now and how do i go bout it, i am gonna contact ACASS after the weekend its just now i have evidence and examples of his bullying and i just need some help to put the case together as quickly as possible i dont know how long i have to accept or refuse the offer on the table, i emailed my union on monday and asked them and they havent even replied……….

    ffs rant over lol big chubster hugs pikey for takin the time to answer hun…and i am going to post on the site geordie suggested……… the thing is my work colleagues are not standing with me for fear of there own jobs,,,,,,,do they not understand if i dont make a stand it could be any one of them next, he apparently did it to my predecessor and she gave up without a fight

    Cath, pm me hun and I will help you. I am qualified in employment law and look at cases like this everyday in work, Im sure I’ll be able to give you a hand.

    In the meantime, make sure you date and document EVERYTHING. Any conversations you have with the union or your boss follow up with an email so that you have something in writing confirming any discussions. If you can get the offer of increment and letter of apology in writing, even, perhaps as a note of the meeting, that would be helpful. Perhaps, even just say that you want to discuss the offer… and want to be clearof what is on the table. Have you kept a log of dates/events/discussions or incidents where you have felt bullied or intimidated. If not, start doing so immediately.

    When did you lodge your grievance, as normally company procedures state the length in which management have to respond (normally max of 10 working days)… or are you not at this stage yet. Management should attempt to resolve this locally, prior to going down that route.

    As for taking you under capability issues, have you had any formal counselling etc regarding your performance. Again, has anything been documented?

    Do you have an Occupational Health Department? If so, I would suggest that you make an immediate self-referral. Not only will they be able to give you some support, but it could assist with your case.

    Are you aware of anyone else who has experienced similar from this person? If so, are they prepared to speak up. You need to be careful how you approach this one however, particularly in the workplace.

    Anyway, like I said, drop me a pm and I will try and help. In the interim, chin up, and try not to let it grind you down hun xx

    Cath do your self a faver and drop it.

    You don’t need the stress or money that bad. It will take a toll on your health and your family life.

    You will have to spent the next 2 years + sorting this out and spend money on it too.

    If the guy has sack you and you are on benfits, the jobcente staff will help you.

    I understand how you feel and why, but in this case, you would be better off droping it and getting on with your life.

    I agree it takes time and money and a lot of both but sometimes its PRINCIPAL in the reasons. Follow your heart if they are wrong they need showing, aslong as you got rights CATH chick RIP EM TO BITS xxxxx

    It’s a total waste of time

    As CAth said she is being re-instarted or whatever and given the current rise

    Why make a fuss and enemies about it just for the sake of principle

    Prinicipled people without a job are a fat lot of use !!!!

    You can’t beat the system whatever you think – if a company wants to sack you they will do – what can the courts or anyone do about it ?? – fine the company , slap their hands – close them down at a cost of hundreds of jobs !!!!!

    Put your energies into something useful – just get on and forget it

    Having been in a similar position I have to disagree. People shouldn’t get away with treating people like that and I think you should fight it. Not only is your integrity at question if you don’t but you’re also potentially allowing someone else to be targeted as you have. It takes a brave person to stand up and fight through something like this and having been in a similar position in the past, I admire your strength to do so. One of the hardest parts is admitting to yourself its gone too far and actually standing up to the bully… you’ve managed that part, many don’t. Keep fighting and stay strong hun, these people deserve to meet the consequences of their actions!!! Good luck chick! x

    Yes, but you all sound under 40 and I think when you get older you will all understand.

    If all your going to get is a few thousand, why bother?

    People own me money all they time and sometimes its not worth the trouble getting it back.

    In this case, I would have throught that the small claims court would be they best way, bu its no going to get caths job back.

    And this guy will probley just change the company name anyway after the jugment, and you wil have to go thru it all again!
