    He is a hacker because he ‘hacked’ into the US computer system without permission.

    What needs to be determined was his motivation and only then can an appropriate sentence be administered. If his intent was to cause trouble and inadvertently put secrets and hence people’s live at risk, then the I feel he should be dealt with by the Americans and with the full force of their laws as they deem appropriate. If it can be established that his motives were trivial then a more appropriate sentence would be to make him help the US government close the loop holes in their computer system to their satisfaction. They may wish to lock him up while he’s there however. Perhaps he should have his Internet access restricted for a length of time too-put him on dial-up!

    So I’d order a full psychiatric report on him, if his condition may account for his behaviour etc (he is still culpable however, just as a serial killer may be ‘insane’ but is still responsible for his crimes). I’d also ask for information on the possible treatment he may received in the USA if he were extradited as the USA do seem to violate the human rights when they deem it appropriate.

    I’d just give him a job………………..for the reasons I stated previously.

    And the fact he did what he did, which is malicious and comes under a whole host of new laws developed since the internet age, involving privacy and god knows what else, just shows that it is possible to do it, and there will be others out there trying right now!

    this is such a difficult one to fully answer really, thing is , yes he has aspergers syndrome, i dont understand enough about that to comment to be fair, but, he is obviously a very clever person too , to have hacked into us computors anyway.

    i think that perhaps mims is right, give the guy a job with top security places to find loopholes in their systems? seems the obvious answer to me.

    Hi Cath …. i’m still here – even though the weather is simply bloody awful outside !!!

    Going back to Gary “hacky” McKinnon …. the ‘discovery’ of Asperger’s Syndrome is relatively recent and many think that it was simply a ruse on the part of his defenders to try to find grounds for avoiding him being extradited to the US to face charges for what he (allegedly) did.

    Equally, the most recent reason raised is that he is said to be suicidal and “will definitely” commit suicide if he is extradited. It seems that his legal team (paid no doubt by yourselves through the legal aid fund) are leaving no stone unturned in their attempts to persuade the powers that be to prevent hacky Gary from being tried for his alleged crimes.

    Yers it is true that there are numerous cases where ‘hackers’ have been offered a job by the hacked organisation. however, this is usually done by commercial organisations – not by the military establishment. They take an altogether more serious view of hacking and prosecute whenever and wherever possible.

    Does anybody know what the US equivalent is of “porridge”???
