A JUDGE has ruled that Northampton South MP Brian Binley’s six-month driving penalty for speeding should stand, because he had enough funds to provide replacement transport for himself during the ban.

Yesterday he made an appeal before Northampton Crown Court to have the ban overturned as it would mean his constituents would suffer “undue hardship” if he could not drive to appointments.

The 65-year-old county councillor was banned for six months in March by Towcester magistrates after admitting travelling at 37mph in his Jaguar XJ6 in a 30mph zone in Wellingborough.

The offence last August was his fourth since 2003, taking the number of points on his licence to 12.

Giving evidence, Binley told the court his constituents would be the people who suffered.

He claimed he would find it difficult to pay for a driver or taxis on his annual MP’s salary of £59,000, his allowance as a county councillor of £7,000 and the monies he received as a non-executive director of the firm he set up, BCC Marketing, which totalled £8,000 a year.

But Matthew Brookes-Baker, for the Crown Prosecution Service, asked Mr Binley how much of a stake he still held in the company. Binley told him that he owned a 20 per cent stake in the private limited company.

Asked by Mr Brookes-Baker if he could not comfortably afford taxis or a private car for six months, Mr Binley said:

“I could pay, but the money I earn is taxable money and I have to pay for a family, keep two homes and being an MP costs a great deal of money.”

Judge Bray rejected the appeal saying: “Though we accept there can be inconveniences for him, we find that he has the resources to provide transport for himself during the short six-month disqualification.”

He also ordered Binley to pay £184 court costs.

:D He earns £74,000 a year, but after tax, he couldn’t manage to get his body around his constituency, well he should’ve thought about this before he broke the law.

When are the people of Northampton South going to appologise for voting in a light weight.

Oh, and er yeah, i nearly forgot, the local media link doesn’t state which party he belongs to, media – old gang, old gang – media.

Emma, its a “local” paper- local papers dont print MP’s affiliations because “local” people know which party their “local” MP is from without having to repeat it every time the “local” paper mentions the “local” MP’s name.

Happpens here too, every time the Lincoln MP’s name is in the “local” paper, it nevers mentions Labour as everyone round here knows she is a Labour MP cos she’s the “local” MP.

how about starting posts about your wonderfull party members I bet it read with many strings of convictions eh….

this aint really a bad offence but its morally wrong… a Nurse was off sick with extreme back ache… but was seen and photographed putting up bunting around the area for Tommy Sherdian…

she is abusing the NHS… being paid as supposed to be off sick but she fit and dandy to do work for TS eh…. she should be sacked from her job…

5 of our top council members just got the golden handshake and some bonuses on retiring for their posts to be filled by their wives…!!!! they all line their own pockets you don’t get honest people doing these jobs eh….

What would be wrong in stating the party he belonged to? The article named where he’s an MP, why do people need to know that if he’s local? Whats your local MP/councillor(s)?

Ive seen who the Leic south MP is, ive heard him talk, numerous times, but for the life of me even now, i cant quite remember his name.

Had it been a BNP councillor, it would be worded constanly.

“how about starting posts about your wonderfull party members I bet it read with many strings of convictions eh….”

How about it? Why hasn’t those that have done, done so with the party they favour? Why havn’t you asked them to do that?
