I don,t beleive this. That bloody useless Shoesmith is likely to have to stand down, but with a bloody fat pay cheque to go with it!! I hope it bloody chokes her. :evil:

payoffWhilst I totally agree with the sentiments behind the article in the Daily Fascist (sorry …. Mail) as always they are looking for a provocative headline without any regard for the underlying facts.
The dreadful Shoesmith is the Director of Education and Children’s Services and has a ‘legal’ contract with the LB of Haringey. Her appointment can only be terminated without pay etc IF she is PERSONALLy in breach of her contract (gross misconduct; a criminal offence; etc etc). If her contract is terminated by her employer for any other reason (i.e. she is FORCED to resign) then they themselves are in breach and must compensate her acordingly. This is what they will be doing it seems…… IF she is forced to resign.
These contracts are pretty tightly worded, in conjunction with advice from the LA’s Legal Department and HR Department. I know this as I was very involved in the interview and appointment of my Local Authority’s Director of Education & Children’s Services and was involved in setting up his remuneration package.
Whether we like it or not (and most of us DON’T) she was only doing what ANY equivalent Director would do – that is to defend her department. Sadly, the manner in which she chose to do it, and the apparently arrogant and uncaring attitude that she displayed whilst appearing on national TV has clearly damaged her and no doubt made her position untenable.

Amen to that pete. All it wants is for the both of them to “slip over” in the shower whilst they are inside. Then leave them laying there for 2 hours like they did to the lifeless body of that little boy, whilst they disposed of the sheets they,d never changed since the day he was born.
:evil:2 December, 2008 at 3:57 pm #386877Well it now seems as though Sharon Shoesmith is to get the Spanish violin (el bow) from LB Haringey following the release of the ghastly details of the Baby P enquiry.
I am greatly amused however, at the reporting antics of the so-called popular Media. “Don’t pay her” they scream. “Failure should not be rewarded” and so on.
As I’ve said already, she has a perfectly legal contract of employment and if her employers terminate it (or constructively dismiss her) then they will HAVE to pay her dameges in breach of contract. If they try to avoid this, they will be utterly stuffed at a Tribunal.
Remember the chief executive of the Maidstone NHS Trust a while ago? She was ‘sacked’ following a public outcry over low standards and high death rates in her hospital. When the Media discovered that she would be entitled to receive an enormous severance package (damages for breach of contract) the Government stepped in and grabbed some juicy headlines.
“She won’t get a penny” they all screamed. OK so once the fuss had died down, the NHS did what it was going to have to do all along and settled with her (the previously mentioned ‘enormous severance package’).
Dear Sharon will get her big fat cheque and her enhanced pension contribution, no problem. Tough at the top ain’t it?

no pay off9 December, 2008 at 12:17 am #386879I wouldn’t chortle too early if I were you. She will have a pretty tight contract of employment and my bet is that her union will be obliged to defend her.
How about the next headline is “Sharon Shoesmith sues LB Haringey for unfair dismissal” or better still “I was victimised” claims unfairly dismissed Sharon Shoesmith.
Watch this space!
BTW: don’t run away with the idea that I am defending her ….. far from it. But I do understand the realities of life and in particular Local Authority employment contracts.
9 December, 2008 at 7:08 am #386880You’re right PB – she probably will play the unfairdismissal card & walk off with what she thinks she’s owed & some (compo for personal suffering due to the stress) !! :roll:
Shame that courtesy wasn’t extended to Baby P & I dare say the many more children that her & her department failed!
At the end of the day SOMEONE in that department (or several) has got to be accountable foir the many major c*ck ups that ultimately resulted in a childs totally unnecessary death.
Sack the lot of them because for all the good they have shown themselves to do the might as well not be there.
Never ceases to amaze me the ammount of very well paid bosses that pass the butt when the poo hits the proverbial fan, yet have no problem drawing a huge pay check every month & & big wad of cash on retirement.

It’s all very well for the tabloid Media to scream for her blood, but they only do this to wind everybody up and thus sell more of their fish-n-chip wrappers.
Like it or not, she is an employee and as such she has legal rights – just like the rest of us. Kicking her out without a penny isn’t ”justice” it IS vindictive and legally it IS unfair.
Her real punishment is that she is at the top of her profession and she has now fallen right to the bottom. She will never be able to get another job at anywhere that level again. THAT is her punishment.
Kicking her out just before Christmas (“Happy Christmas Sharon….. oh and BTW – YOU’RE FIRED!!!”) with no compensation and way of paying her mortgage or any of her household bills seems to me to be totally over the top. After all SHE didn’t commit a criminal offense; SHE didn’t murder a child did she?

The council rightly waited for the report before their decision.
If you heard the news over the weekend, you will have heard Ofsted state they were lied to during their inspection into Haringey social services and had data witheld from them.
My guess is there will be no appeal, no pay off- she has gone under gross misconduct and the council have got this one right. Playing it this way has protected them from a future unfair dismissal case.
Not that I am defending the council any more than I have to.
