In the news recently the “wannabe PM” was going for the female vote by claiming he would change rape law to prosecute more rapists
So is that A) really possible and B) particularly wise?
We are bombarded with claims that too many “rapists” get off with it (excuse the pun) but if we are objective that cant really be known can it?
And the ways in which more prosecutions will be applied also need sctutiny as one previous plan was to class it as rape if a woman has had any alcohol to drink whether the man was also drunk and EVEN if he was drunker than her it WOULD then have been classed as statutory rape based solely on her having had a drink (I jest you not)
Also, where is his equal claim that women who falsely accuse will be jailed for a similar legnth of time as a convicted rapist and will EQUALLY be named and shamed?
And where is the far more equal promise of BOTH parties being allowed anonimoty UNTIL a verdict is arrived at?
Our legal system is based on proof or the burden thereof
Yes this does have some problems with crimes like rape, but I really dont think moving to an assumption of guilt is a step forward as it would be like trying to increase the amount of shoplifters arrested by classing walking within 5 metres of the exit as now being shoplifing
Rape is a very complex topic unlike the rather dumbed down simplistic way its portrayed in the media and I think approaching it objectively and through education and by encouraging women to be more responsible for their own safety would be a much better way to try and reduce rape than moving the legal goal posts so that it simply becomess easier to prosecute as that will also mean more non rapists will be jailed for rape I think
This feels very much like the asbo revolution, a way to curry public support and votes by not actually tackling the problem at all, but by simply introducing inherrently flawed and illthoughtout laws so it LOOKS like the problem is being tackled
Thoughts?
13 November, 2007 at 2:29 pm #293056Whilst there is NEVER any excuse for a man to rape a woman, I do agree with you about educating women to take better care of themselves when they are out having a good time. So often you see these horrendous pictures of drunken women, falling over in the street, spreadeagled so far you can see all the way to Australia for Christs sake. Young women these days like to think they can keep up with the men and regularly drink themselves into drunken oblivion every weekend; downing bottles of alcopops and vodka as if their lives depend on it. They have no regard for their health, only having a good time, and they certainly don,t have any respect for themselves. They go out half naked, with everything on show and the next morning, there they are, spread all over the pavement throwing up. Why does having a good time have to involve getting out of your tree on booze? Most of the time they have NO recollection of where they are, or even WHO they are. Yes the laws need to be tougher on the rapists, but these silly women MUST learn to take better care of themselves. because there will always be some guy who won,t think twice about taking advantage of a women in that state, and then when that happens, whose fault is it?

I thought that bit was not only interesting but also suspiciously media driven
Think about it for a moment

It sort of suggests that ANY man who has sex with a woman in that state is “taking advantage” which is sort of the problem to begin with really
Its known that alcohol lowers inhibitions in men AND women, its not unheard of by a lot, maybe even most men to have been practically ravaged by a drunken woman who otherwise wouldnt have been so voracious or predatory
And it ALSO assumes the “man” in question is more sober than the woman when its often the case that he will actually be JUST as bladdered as she is
Also, when was the last time you heard of a woman having sex with a man who was more drunk than she was being described as her “taking advantage” of him?
The media dictates how people “should” stereotypically view a situation, that rarely relates to fact or actuality, but simply to political or social aims that are wanted to be projected slowly onto society
The predominant one with sex is that “men have sex with women” rather than men and woman have sex with each other. and that rather subtle social pavlovian indoctrination crops up all over the place as tho its a truth
IE, men have sex/women give or allow it sort of mentality
Men fuck, women GET fucked
Admittedly not everyone applies this tainting of perspective without question, but the majority still do until its questioned and many cant even step back and look at it objectively even then

Would you HONESTLY see a drunken woman having sex with an even more drunken man as her “taking advantage”? Would you be JUST as likely to word it in that exact same way?
It wasnt the total sentence I was actually referring to, but as I did expand on, just the bit where “taking advantage of” was used
Its VERY widely used where the woman is the more drunk of the two, but is rarely commonly used when its the man thats the more drunk of them
And thats massively influenced by the media both directly and indirectly
15 November, 2007 at 1:15 pm #293060i know a woman who was cought out having a quick fling behind a pub years ago she then cried rape and put the poor fella through months of worry and fear, he didnt rape her at all she was seen by her botfriends mate and that was it she cried rape. anyway upshot was she was well and truly proven wrong and admitted as much eventually, she was then duly brought before the courts and given a six month prison sentence for purgery and perverting the course of justice. as far as im concerned she should have been given the same centence as the poor fella would have gotten if the lying lill cow had not been cought out.
on the other hand as you say when an 19 year old lass falls out of a nightclub too drunk to see people wil take advantage and literally do as they see fit with the girl, going out dressed as a pole dancer in th middle of winter and getting blind drunk isnt the best way to look after yourself or your mates. mabey girls should have a designated angel on a night out who will make sure all her mates get into taxis and get home safe. bit itll never happen cos nowadays the women are as bad as the men [worse sometimes] when it comes to a quickie after a night on the town its a tough one where to draw the line.15 November, 2007 at 4:13 pm #293061Something like that happened here recently. A girl got drunk at a party and had a threesome with two equally drunk guys. In the cold light of day however, she thought to herself ‘What have I done? What are my friends and family going to think of me?’ She cried rape to save getting a reputation.
Thankfully, her conscience got the better of her before it went too far but that doesn’t excuse anything. The issue of consent is a tough one and I have to agree with waspish, where do you draw the line?
