A dad who used a samurai sword to wound a thug threatening his family in their home was cleared of assault.
David Fullard opened his door to find two drug-crazed drunks armed with a knuckleduster and a spade and demanding money.
After they threatened to rape his girlfriend and kill him and his two teenage sons, he grabbed the ornamental sword and severed an ear from one of the men with a single blow.
The Crown Prosecution Service refused to believe it was self-defence and charged him with unlawfully wounding the man – named Michael Severs – saying it was “over the top to use a battlefield weapon on someone”.
Mr Fullard, who faced eight years’ jail if convicted,was cleared by a Hull jury in November but reporting restrictions were imposed as the yobs were due in court for affray.
His ordeal was revealed yesterday as Severs, 22, and pal Michael Smith, 19, who pleaded guilty, walked free from Hull crown court after being given six-month suspended sentences.
His partner Susan Neal, 54, had told the jury that Smith picked up the sword and said: “Do you want some of this?”
She added: “They threatened to rape me, burn the house down, kill the kids and kill Dave.”
The jury had some sense but the law is still an ass… he should never have been prosecuted and the real offenders got suspended sentences :shock:
I beleive he only used the sword because it was the first thing he grabbed, and he wasn`t planning on severing an ear.
This case should have never been brought to court, but at least the verdict is a step in the right direction.
And I`m sorry, but I love the poetic justice in the name :)
